    Of course we want people to stop making the hazardous boat journey to Christmas Island, but tow-backs and off-shore processing are immoral and stupid. Australia must engage with others in the region to find ways to ensure people are not driven to make desperate journeys.

    Julia Gillard asked her advisers to design a system not for offshore processing but for offshore dumping. If John Howard had tried this in 2001, Labor would have gone ballistic. The advice of Gillard's intermittently trusted advisers is no longer worth the paper it is written on.

    From now on, the High Court will apply a very fine tooth comb to any legislation allowing ministers to ship asylum seekers offshore.  Unless there were to be a bipartisan agreement in the Parliament or a government deal with the Greens, asylum seekers arriving by boat now need to be processed fairly, promptly, on our terms and on our turf.

    The Malaysian solution is unprincipled, but it might just work — stopping the boats. If other countries try to replicate it, we will have to tear up the Refugee Convention and start again. And the plight of unaccompanied minors transported from our shores to Malaysia will be on our conscience.

    According to the Coalition, 'bad refugees' who come on boats take places that could otherwise go to 'good refugees' who wait patiently in camps. Labelling refugees as 'good' or 'bad' according to how they arrive in Australia reflects an insular opinion that does not reflect what is happening worldwide.

    Julia Gillard insists that the centre in East Timor centre would be properly 'run, auspiced and structured'. For the Australian Government to ensure that such a centre respects the human dignity of asylum seekers will be difficult. Similar arrangements with Indonesia were not satisfactory.

    The Coalition's new asylum seeker policy returns to the policy it put into practice under Mr Howard, adding new nasties. The Government's asylum seeker policy is bad; the Coalition's is worse. It is designed to appeal to human baseness, not to human generosity.
